The Registry of Deeds
After the issuance of the BIR CERTIFICATION and TRANSFER TAX, Mrs. J goes back to the Municipal Treasurer of Marilao, Bulacan to submit the CURRENT TAX RECEIPTS and requests for issuance of TAX CLEARANCE CERTIFICATE (Php30.00 for issuance of Tax Clearance Certificate with official receipt).
Mrs. J will proceed to the REGISTRY OF DEEDS at Meycuayan, Bulacan for the transfer of the title.
Requirements:
- TAX CLEARANCE - under PSPI's name
- TAX DECLARATION - under PSPI's name
- TRANSFER TAX - under the buyer's name
- BIR CERTIFICATION / CERTIFICATE OF AUTHORIZING REGISTRATION - original copies.
- Proof Of Payments (WITHHOLDING TAX and DOCUMENTARY STAMPS) - original copies.
- DOAS
- ORIGINAL TITLE
- SECRETARY'S CERTIFICATE / BOARD RESOLUTION under the names of PSPI-DPVI
- SPA (PSPI-DPVI)
The process at the Registry of Deeds is as follows:
- Mrs. J files the documents at the REGISTRY OF DEEDS to record all documents submitted at the entry logbook.
- Mrs. J will proceed to the cashier for payment of registration fees.
- The documents go to the RECORDS SECTION for verification purposes, and then the Records Officer will assign an Examiner and typist for the NEW TITLE.
- After the Records Officer approves the documents, he will issue the new title and pass the documents back to the Examiner to be received by him/her.
- The Examiner verifies and evaluates the documents submitted and gives them to the assigned typist.
- The typist will type the name of the new owner and cancel the name of the previous title of the owner (PSPI).
- The typist then signs his initials on the new title.
- The new title goes back to the Examiner for counter-checking and signs his initials on the title.
- The Examiner will bring the new title to the Registrar of Deeds for final signature
- The releasing clerk then gives the new title to the new owner.
NOTE: The entire process will take about 2-3 days.
- Mrs. J goes to the Municipal Assessor of Marilao, Bulacan for the transfer of the tax declaration from the developer (PSPI) to the new owner's name (Mrs. J).
Two (2) photocopies each of the following are required:
- DOAS
- TRANSFER OF TITLE -under Mrs. J's name
- TRANSFER TAX-under Mrs. J's name
- TAX DECLARATION - under PSPI's name
- BIR's CERTIFICATION / CERTIFICATE OF AUTHORIZING REGISTRATION - under Mrs. J's name.
- Proof of payments (WITHHOLDING TAX / DOCUMENTARY STAMPS)
- CURRENT TAX RECEIPTS - under PSPI's name
NOTE: The buyer has to follow up his application for the transfer tax declaration under his name. The whole process will take about five (5) days.
