Development Permit
Under RA 7160 (also known as the Local Government Code of 1991 that took effect on January 1, 1992) and as detailed under E.O. No. 71 and E.O. No. 72, the City or Municipality has been empowered: to adopt a comprehensive land use plan, reclassify land within their jurisdiction and enact zoning ordinances. With these powers the LGU's are the one's who will approve the submitted subdivision plan in accordance with the Subdivision Standards and Regulations. The Title should be FREE from all leins and encumbrances. The city engineers and local council issue the development permit by the local council upon issuance of the locational clearance and the approval of the subdivision plans and project. For condominiums, it is still the HLURB that gives the Development Permit, the building must be in accordance with National Building Code No. 6541.
